Using HostPilot
These terms cover your use of HostPilot, including our website, hosting console, and the services you order through it. By creating an account or using our services, you agree to these terms and any service-specific conditions shown when you place an order.
If you use HostPilot for a business or another organisation, you confirm that you have authority to act on its behalf. In these terms, ‘you’ includes that organisation, and ‘we’ means HostPilot.
Your account and team
Keep your account, billing, and contact details accurate. Protect your sign-in credentials and let us know promptly if you suspect someone has accessed your account without permission.
Use individual accounts for teammates and give each person only the access they need. You are responsible for the people you authorise to use your workspace and the services they order or change on your behalf.
Hosting and availability
HostPilot helps you manage servers, websites, containers, DNS, and related services on New Zealand infrastructure. The features, capacity, and charges for a service are those described when you order it.
We will provide our services with reasonable care and skill. Maintenance, network faults, and incidents affecting our infrastructure providers may interrupt availability. Any specific service-level commitment must be set out in your service agreement.
Acceptable use
Use our services lawfully and respect the security, privacy, and rights of others. You are responsible for the content and applications you host and for keeping software under your control secure.
- Do not host unlawful content or infringe someone else’s intellectual property or privacy.
- Do not distribute malware, send spam, run phishing campaigns, or facilitate fraud.
- Do not attempt unauthorised access, disrupt networks, or test systems you do not have permission to test.
- Do not bypass service limits or use resources in a way that harms other customers.
Billing and payments
You agree to pay for the services you order at the price and billing interval presented to you. Review the currency, taxes, and recurring charges shown before confirming a purchase, and keep a valid payment method on file for paid services.
Recurring services continue to be billed until cancelled using the controls for that service. Turning off a server or no longer using a resource does not cancel it. Check the cancellation confirmation for when billing and access will end.
If a charge looks wrong, raise it promptly so we can investigate. Refunds and other remedies required by law remain available. Any additional refund conditions will be stated with the relevant service.
Domain names
Domain registration, transfer, and renewal depend on availability and the applicable registry and registrar rules. A search result does not reserve a name; registration is complete only when the registry accepts the order.
Keep registrant details current and check your domain’s expiry date and auto-renew settings. A failed payment or an expired registration can interrupt your website and email, and an expired name may become available to someone else.
Your content and data
You retain ownership of the content you upload or host. You give us permission to store, process, and transmit that content only as needed to provide and support your services. You must have the rights and permissions needed to host it.
Keep independent backups of important data and check that they can be restored. Backup features and retention depend on your service; they do not replace your own recovery planning. Export anything you need before deleting a resource or ending a service.
Suspension and cancellation
You can stop using HostPilot and cancel your paid services through the available service controls. Removing a team member or signing out does not cancel workspace resources. Charges already incurred remain payable, subject to any refund or remedy you are entitled to.
We may restrict or suspend affected services for non-payment, a material breach of these terms, or a security or legal requirement. Where reasonably possible, we will explain the issue and give you an opportunity to resolve it. Urgent action may be needed to protect people, data, or infrastructure.
Deleting a resource can permanently remove its data. Arrange any backups, exports, and domain transfers before cancellation or deletion.
Your rights
Nothing in these terms excludes or limits rights or remedies that cannot lawfully be excluded, including any rights you have under New Zealand’s Consumer Guarantees Act 1993 or Fair Trading Act 1986.
If a service does not meet our obligations, let us know so we can investigate and work towards a remedy. These terms do not prevent you from using an available complaints process, tribunal, or court.
Changes to these terms
We may update these terms as our services or legal obligations change. We will publish the revised terms here with an updated date and give reasonable advance notice of material changes that affect existing services, unless an urgent legal or security reason prevents that.
Changes will not apply retrospectively. If you do not agree to a material change, you may cancel the affected service before it takes effect, subject to your existing rights and any charges already incurred.
Governing law
These terms are governed by New Zealand law. The New Zealand courts have non-exclusive jurisdiction, without limiting any mandatory protections or rights to bring a claim that apply where you live.
